Terms of Service

Welcome to WebPush ("Platform", "Service", "We", "Us", or "Our"). Please read these Terms of Service ("Terms") carefully. By registering an account, integrating our tracking scripts, deploying our WordPress plugin, or accessing any service features, you ("User", "Website Owner", "Customer") expressly agree to be bound by these legal terms.

If you do not agree to every provision contained herein, you must immediately cease all access, remove all integration scripts, and terminate usage of our software.

1. Acceptance of Terms & Scope of Service

WebPush.in provides web push notification dispatching software, subscriber token storage, landing page bridge links, and campaign scheduling tools. These Terms apply to all registered users, website owners, publishers, and visitors utilizing our service endpoints or integration tools.

2. Absolute "AS-IS" & "AS-AVAILABLE" Warranty Disclaimer

THE SERVICE, SOFTWARE, API, SCRIPTS, CONTROL PANELS, AND INFRASTRUCTURE ARE PROVIDED STRICTLY ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT ANY WARRANTIES OR GUARANTEES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, FREEDOM FROM VIRUSES OR MALWARE, AND UNINTERRUPTED SERVICE AVAILABILITY.

🚨 PUSH DELIVERY & SUBSCRIBER TOKEN DISCLAIMER:

Push notification transmission depends entirely on third-party infrastructure outside our control, including Google Firebase Cloud Messaging (FCM), Apple Push Notification service (APNs), and client browser vendors (Chrome, Firefox, Safari, Edge, Android OS, iOS). Delivery will fail, experience latency, or drop due to:

  • Device power-saving mode, battery optimization, or background app sleep settings.
  • Browser cookie clearance, cache resets, or permission revocations by end-users.
  • Third-party push broker (FCM/APNs) token invalidation, key rotation, or network throttling.
  • Client-side offline status, firewall blocks, or network packet drops.

WE GIVE ZERO GUARANTEES REGARDING NOTIFICATION DELIVERY RATES, SPEED, CLICK-THROUGH CONVERSIONS, OR TOKEN RETENTION LENGTH.

3. Cyber Security, Cyberattacks & Data Breach Non-Liability

WebPush.in implements best-effort administrative and technical security measures (including SSL encryption, database isolation, and access controls) to safeguard platform data. However, internet transmission and digital data storage are inherently vulnerable to third-party cyber threats.

⚖️ DATA SECURITY & BREACH LIMITATION CLAUSE:

By using WebPush.in, you acknowledge and agree that no web infrastructure or database is 100% hacker-proof or immune to unauthorized intrusion. IN THE EVENT OF ANY CYBERATTACK, SERVER HACK, DATA BREACH, MALWARE INFECTION, UNAUTHORIZED DATA EXPOSURE, DATA LOSS, OR TOKEN LEAKAGE BEYOND REASONABLE TECHNICAL SECURITY MEASURES:

  • WEBPUSH.IN, ITS FOUNDERS, OPERATORS, DEVELOPERS, AFFILIATES, AND SERVER HOSTING PROVIDERS SHALL BE 100% EXEMPT FROM ANY LEGAL ACTIONS, FINANCIAL DAMAGES, LIABILITIES, REGULATORY FINES, OR LAWSUITS.
  • YOU AGREE THAT YOU WEAR ALL RISKS ASSOCIATED WITH DIGITAL STORAGE OF ANONYMOUS BROWSING TOKENS OR WEBSITE CONFIGURATIONS.
  • WEBPUSH.IN DOES NOT ACT AS AN INSURER OF YOUR SUBSCRIBER DATA OR CAMPAIGN ASSETS.

4. Absolute Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEBPUSH.IN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF PROFITS, REVENUE, GOODWILL, OR SAVINGS.
  • LOSS OF DATA, SUBSCRIBER TOKENS, OR CAMPAIGN ASSETS.
  • SERVER DOWNTIME, SITE DISRUPTIONS, OR HARDWARE NODE FAILURES.
  • UNAUTHORIZED ACCESS, HACKING, ALTERATION, OR DESTRUCTION OF DATA.
  • THIRD-PARTY ACTIONS, SPONSORED DISPATCHES, OR CONTENT SENT BY WEBSITE OWNERS.

IN ALL CIRCUMSTANCES, OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS UNDER THESE TERMS SHALL BE STRICTLY LIMITED TO THE LESSER OF FIFTY US DOLLARS ($50 USD) OR THE ACTUAL TOTAL AMOUNT PAID BY YOU TO WEBPUSH.IN IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE CLAIM.

5. User Indemnification Agreement

You agree to defend, indemnify, and hold completely harmless WebPush.in, its founders, operators, officers, developers, and partners from and against any third-party claims, liabilities, lawsuits, losses, judgments, damages, regulatory fines, and legal expenses (including reasonable attorney fees) arising from or related to:

  • Your website content, push notification dispatches, landing page links, or promotional campaigns.
  • Your violation of any applicable local, national, or international laws, including privacy and anti-spam regulations (GDPR, CAN-SPAM, IT Act).
  • Your breach of any representation or warranty set forth in these Terms.
  • Any dispute between you and your website subscribers or visitors.

6. Free Partner Plan, Plan Switching & Network Rights

Users activating the Free Partner Plan or switching plans acknowledge that the plan operates as an ad-supported partner tier. Under platform policy:

  • Plan Downgrade / Switch Token Policy: If a user switches from a Paid Custom Plan to the Free Partner Plan or Trial Plan, all existing subscriber tokens accumulated under the account (e.g. 10,000+ subscriber tokens) remain active in the WebPush.in network broadcast pool. WebPush.in reserves full rights to send 2-3 daily sponsored notifications to all such tokens under Free Partner Plan terms.
  • Free & Trial Export Retention Policy: Free Partner Plan and Trial Plan users are not granted standalone CSV/Excel subscriber token exports. Even if any token backups or exports are ever generated or accessed, WebPush.in retains a permanent copy of all subscriber tokens in the network pool to continue 2-3 daily sponsored dispatches as agreed under free tier partner policy.
  • Service Closure & Backup Grace Period: In the event WebPush.in decides to discontinue, sunset, or shut down the website or server infrastructure, WebPush.in will issue a prior notification (e.g. 30 days notice) enabling users to download their data backups within the stipulated window. Following the expiration of the notice period, WebPush.in reserves the right to close servers and terminate operations at any time without further liability.

7. Prohibited Content & Immediate Account Termination

You agree NOT to send push notifications containing:

  • Phishing links, malware downloads, tech support scams, or deceptive claims.
  • Illegal content, hate speech, explicit adult content, or unauthorized copyright violations.
  • Unsolicited spam dispatches violating local communication laws.

WebPush.in reserves the sole right to immediately suspend or permanently terminate any account or website domain violating these guidelines without refund or notice.

8. Governing Law & Exclusive Jurisdiction

These Terms shall be governed by and construed in accordance with local jurisdiction laws, without regard to conflict of law principles. Any dispute or claim arising out of these Terms shall be resolved exclusively in competent local courts.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
